TERMS AND CONDITIONS FORREST SPACE

§1 General Provisions

1. The owner of Forrest Space Recreational Facility in Wola Rafałowska is Wojciech and Miłosz Początek conducting business under the company: Traktor.com.pl S.C. Wojciech and Miłosz Początek with its registered seat in Rzeszów, 8 Leszka Czarnego Street, 35 – 615 Rzeszów, NIP: 8133840648, e – mail: info@forrestspace.com

2. These Rules and Regulations apply to the Forrest Space Facility and set forth the rules for the provision of services, liability and stay at the Facility and are an integral part of the Agreement, which is concluded by making a reservation, paying a deposit or the entire amount due for a stay at the Facility. By performing the aforementioned actions, the Client confirms that he/she has read and accepts all terms and conditions of these Regulations and agrees to abide by them. The Regulations are binding on all Customers of Forrest Space Facility.

3. Whenever referred to hereafter in these Regulations:

a) Facility – it shall be understood to mean the Forrest Space resort and the separate premises comprising it,

b) Client – shall be understood as any person staying at the Facility in connection with the concluded Agreemen

4. The Rules and Regulations are available at www.forrestspace.com and at the Facility in Wola Rafałowska.

5. On the premises of the Facility there are no permanent employees, reception or staff at the disposal of the Clients so it is only possible to contact them at e:mail: info@forrestspace.com or phone number: +48 737301807.

6. The facility is intended only for adults, which means that the reservation for a stay may include Clients who are at least 18 years old.

7. On the premises of the Facility it is possible to smoke only outside the buildings and outside the premises and their components (including the terrace) subject to rent. Smoking tobacco or other products is associated with the necessity of cleaning up the cigarette butts in the container designated for waste.

8. It is possible to shop on the premises.

§2 Check-in day

1. Check-in at the Forrest Space begins at 16:00 and ends at 12:00 the following day.

2. If the customer did not specify the length of stay when making the reservation, it is assumed that the stay was booked for one day.

3. Upon request during the stay, the Client may extend the stay for a further period, but should notify the Object no later than 10:00 a.m. on the day on which the originally booked stay expires. The Object may refuse to extend the stay if there are no vacancies in the Object.

4. In the case of extending the stay for 1 (one) night, the Client is obliged to pay the payment for the extended stay before leaving the Property, and in the case of extending the stay for a longer period – to pay the deposit at the time of the extension.

5. Quietness at the object is in effect from 10:00 p.m. until 6:00 a.m. the following day.

6. The fee for the stay shall be charged in advance under the conditions referred to in paragraph 3 of the Regulations.

7. The object may provide for other terms of payment for the stay – and resulting from the (non-standard) applicable offer of the object.

8. The Object reserves the right to change prices, which it will inform by updating the offer with the price list. If prices change between the time the Client makes a reservation and stays at the Facility, the price for the stay is valid at the amount current at the time of the reservation.

9. Full-size beds are available in the Object, which means that it is not possible to prepare an extra bed.

§3 Conditions for booking a stay

1. The client makes a reservation for a stay exclusively through the reservation system provided on the Facility’s website at: www.forrestspace.com

2. Along with making a reservation, the customer is required to pay a deposit of 50% of the value of the stay. The deposit is credited towards the price of the stay. Payment of the deposit is considered equivalent to the conclusion of the Agreement between the Object and the Client.

3.The Client is obliged to pay the remaining amount due no later than 48h – hours before the start of the night at the Object. The payment is collected automatically based on the card authorization made during the reservation process. Along with the payment of the remaining amount but also in case of failure of the automatic payment, the Client is obliged to send a confirmation of the payment to the e-mail address: info@forrestspace.com within 48h before the start of the stay.

4. Failure to make the remaining payment referred to in paragraph 3 is tantamount to cancellation of the reservation made for the stay and forfeiture of the deposit in the amount paid to the Facility.

5. In case of failure to send confirmation of payment of the remaining balance, the Facility reserves the right to cancel the reservation made with forfeiture to the Facility of the deposit paid and the remaining payment.

6. All payments for bookings made are made through Stripe.

7. Regardless of the obligation to pay for the stay, the Client is obliged to pay a refundable deposit in the amount of PLN 500, 00 (in words: five hundred zlotys, 00/100) within 48 h from the booking. The deposit is a security for the Object against any damage caused by the Client during his/her stay at the Object. The fee is collected automatically based on the card authorization made during the reservation process. If the automatic payment fails, the Client is obliged to send a confirmation of the payment transfer for the refundable deposit to the e-mail address: info@forrestspace.com within 48h before the start of the stay.

8. Failure to pay the deposit within the period referred to in paragraph 7 results in cancellation of the reservation. A reservation in relation to which a deposit has been paid and the date of stay falls within less than 30 days from the date of booking results in forfeiture to the Object of the paid deposit in the amount paid by the Client.

9. Lack of grounds for retention of the paid Deposit will result in its return to the Client’s bank account within 5 – business days after leaving the Facility.

10. The facility reserves the right to cancel a reservation for reasons beyond its control, as well as fortuitous reasons, which also include, among others: the decision of state authorities, situations related to pandemics or other possible significant circumstances.

11. If the situation referred to in paragraph 10 occurs, the Facility will return to the Client within 14 working days the deposit in the amount paid and (if any) the further amount paid by the Client for the reserved stay.

12. The customer has the right to cancel the reservation made no later than 14 – days before the planned stay. Cancellation of a reservation within the period specified in the preceding sentence will result in an obligation to refund the deposit paid within 14 working days from the date of cancellation.

13. Cancellation of a reservation by the Client at a later date (than the date referred to in paragraph 12) shall result in forfeiture of the deposit to the Facility in the amount paid by the Client.

14. The return and cancellation rules referred to in paragraph 12 do not apply to special and promotional offers.

15. If the Client cancels a reservation made after paying the full amount for the stay (e.g., on the day the reservation begins), the Facility reserves the right to retain the fee paid (in full).

16. In case of cancellation of the Client’s further stay – during its duration – the fee in full for the unused stay is not refundable and will be forfeited to the Facility.

17. Additional charges or services resulting from the stay, must be paid before the end of the stay.

18. The Facility may refuse to accommodate a Client who, during a previous stay, grossly violated the Rules and Regulations by causing damage to the property of the Facility or the Client, or damage to the person of another Client or other persons staying at the Facility, or otherwise interfered with the Clients’ stay or the operation of the Facility.

§4 Conditions of stay

1. Upon arrival at the Facility, the Client completes the accommodation process by using the QR code provided to them via email, which is sent after making the reservation.

2. The provided Facility is cleaned after the Client’s stay at the Facility. Upon the Client’s explicit request, the provided Facility can be cleaned during the Client’s stay at no additional charge.

3. As part of the Facility, the rented space includes basic household appliances for the Client’s use, such as: refrigerator, coffee maker, induction hob, dishwasher, air purifier, steam fireplace.

4. There is the possibility of charging small electronic devices within the rented space.

5. Bed linen and towels are available for the Client’s use within the rented space.

6. During their stay at the Facility, Clients may stay with their pets, provided they inform us in advance when making the reservation.

7. Clients staying at the Facility as part of a booked stay may not transfer the rented Facility to third parties.

8. Persons not included in the booked stay may stay at the Facility at the invitation of the Clients using the Facility until 10:00 PM.

9. Each use of the jacuzzi during the stay is only possible after prior body washing in the shower.

10. Bathing naked and having intercourse in the jacuzzi is prohibited due to site monitoring and hygiene reasons.

11. Water must not be drained from the jacuzzi independently.

12. Scented oils cannot be used in the jacuzzi due to the risk of clogging the water pump.

13. Meals must not be consumed in the jacuzzi, and all drinks should be poured into plastic cups provided in the rented Facility.

14. Bringing glass dishes/items into the jacuzzi is prohibited.

15. There must always be a special float with a antibacterial tablet (provided by the owner of the Facility) in the jacuzzi.

16. After each bath, Clients are obliged to cover the jacuzzi with a wooden cover located near the jacuzzi.

17. Violation of any of the provisions described in points 9-16 of this paragraph, resulting in the need for the jacuzzi to be prepared again, will result in the deduction of the deposit paid by the Client in the amount of 200.00 PLN (two hundred Polish zlotys, 00/100).

18. A garage is included with the rented space as part of the booked stay. There is no direct access to the rented Facility. Entry onto green areas is prohibited. Garages on the premises are unguarded. Parking outside the designated area will result in the deduction of a deposit paid by the Client in the amount of 50 PLN (fifty Polish zlotys, 00/100).

19. A fire pit with wood prepared for ignition is available on the terrace for the Client’s use. The amount of wood is adjusted to the length of stay, assuming approximately 2-3 hours of fire pit burning per day.

20. The Client must not leave the lit fire pit unattended.

21. Whenever the Client wishes to leave the terrace, they must extinguish the fire pit to ensure that the fire is not spread by wind or other random situations.

22. Upon each departure from the rented Facility, all windows must be closed, electrical/electronic devices switched off, and taps closed.

23. The Facility does not offer storage for valuable items due to the lack of permanent supervision on the premises.

24. The Facility is not liable for temporary inconveniences beyond its control, such as temporary power or water outages or Internet network failures.

25. During the stay at the Facility, the Client may purchase products available at the Facility.

26. Each product is marked with an individual QR code, which, when scanned, allows payment via redirection to the Facility’s website and payment system.

27. The Client may also purchase products without prior scanning of the QR code directly through the Facility’s website under the “Shop” tab, by selecting the appropriate product and making the payment.

28. Failure by the Client to pay for products used will result in the amount being deducted from the Client’s credit card after checking out of the Facility.

29. The fulfillment of each placed order occurs immediately after payment. This applies to products available on-site at Forrest Space.

30. The Consumer has the right to withdraw from the sales contract without giving a reason and without incurring costs, provided the purchased product remains intact.

31. To make a return, the consumer must complete a withdrawal form. A sample withdrawal form is included in Annex 2 to the Consumer Rights Act and additionally serves as Annex 1 to the Regulations.

After completing the form, the consumer must send the form by email to info@forrestspace.com no later than the end of their stay at Forrest Space, during which the sales contract was concluded.

§5 Check-Out

1. The Facility must be vacated by 12:00 PM on the day the stay ends.

2. Failure to comply with the above-mentioned time or hour results in the calculation of an additional hotel day.

§6 Liability Rules

1. Clients bear full material responsibility for damages or destruction of equipment and technical devices located on the premises of the Facility, caused by the Client or visitors invited by the Client.

2. In case of equipment failure or damage to the rented Facility, the owner must be immediately notified by phone or email. Failure to report a malfunction or damage will result in the deduction of a repair fee from the deposit or holding the Client liable for damages if the repair cost exceeds the amount of the deposit.

3. In the event of flagrant violations of the Regulations, the Facility may refuse to provide further services to the Client who violates them. In such a situation, the Client is obliged to comply immediately with the Facility’s demands, settle the dues for the stay (if any), cover any losses, and leave the Facility.

4. The Facility reserves the right to a statutory lien on items brought by the Client in case of delay or non-payment or partial payment for services provided.

5. Due to the possibility of leaving a vehicle on the premises of the Facility, the Facility is not liable for damage, loss of the Client’s vehicle, or items left in the vehicle.

6. In the case of staying with pets, the Client is responsible for any damages caused by them according to general principles. The Client is responsible for cleaning up after their pets. Dogs are only allowed to be walked on a leash on the Facility’s premises.

7. During the stay at the Facility, the Client is responsible for providing necessary materials for the pet’s resting place, which should be placed on the floor of the rented Facility.

8. In the event of contamination of the Facility beyond the normal range resulting from use, the Client will be charged an additional fee of 500 PLN (five hundred Polish zlotys, 00/100) plus the costs of repairing any damages.

9. The Facility is not liable for the loss or damage of money, valuable items, valuables, or other items of scientific or artistic value during the Client’s stay due to the lack of deposit services.

10. The use of intoxicants is strictly prohibited on the premises of the Facility. The Client will be liable for damages caused on the premises of the Facility under the influence of intoxicants, and regardless, will be required to pay a penalty of 500 PLN (five hundred Polish zlotys, 00/100) to the Facility.

§7 Complaints

1. The Facility provides services following its category and standard.

2. In the event of objections regarding the quality of services provided by the Facility, the Client has the right to complain within 14 days from the end of the stay at the Facility to the email address: info@forrestspace.com.

3. Complaints will be considered within 14 days from the date of submission, along with informing the Client about the method of consideration.

§8 Additional Provisions

1. The behavior of Clients and other persons using the Facility must not disturb the comfort of other Clients or local residents. The Facility may refuse further services to the Client or persons violating these provisions.

2. The Client may not make any changes to the rented premises and its equipment, except for rearranging the furniture without compromising its function and original layout, and without compromising the safety of the Facility.

3. It is strictly prohibited to bring hazardous items onto the premises of the Facility such as: weapons, ammunition, explosives, flammable materials, illuminating materials, etc.

4. Personal items left by the Client on the premises of the Facility may be sent to the specified address at the Client’s expense. In the absence of instructions regarding the sending of items left behind, they may be stored by the Facility owner for a maximum period of 1 month, after which they will become the property of the Facility.

5. Due to fire safety regulations, the use of electrical devices other than those provided by the Facility is prohibited.

6. The Facility is monitored by video surveillance, which applies only to external parts of the Facility and the surrounding area.

7. Personal data, including images, are processed according to the principles described in the privacy policy on the website www.forrestspace.com, and by making a reservation, the Client consents to the processing of personal data by these provisions.

8. The space around the Facility may not be used for commercial and advertising purposes without the consent of the Facility owner. Such activities require a separate agreement specifying the use of the space and establishing a separate fee for its use.

9. Attachments to the Regulations are an integral part.
